Terms of Service

Welcome to SpaSync! These Terms of Service ("Terms") govern your use of the SpaSync mobile application (the "App") and related services provided by SpaSync ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

These Terms of Service constitute the End User License Agreement ("EULA") between you and SpaSync for the App.

1. Eligibility

You must be at least the age of majority in your jurisdiction to enter into these Terms. If you are not of age, you may use the App only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. You may not use the App if you are prohibited from doing so under applicable law.

2. Description of Service

SpaSync provides a mobile interface to monitor and control compatible spa WiFi modules. Features include, but are not limited to, adjusting temperature, controlling pumps and lights, creating heating schedules, and viewing usage analytics.

3. SpaSync Premium

SpaSync Premium is our paid subscription offering (see Section 4). Depending on the version of the App and our configuration, Premium may unlock features such as: spa usage analytics; smart heating schedules; the Apple Watch companion app; webhooks for home automations (e.g. Home Assistant); and Lock Screen and Home Screen widgets. The exact features included in Premium at any time are those presented in the App and in the App Store subscription description when you purchase or manage your subscription. We may add, modify, or discontinue individual Premium features from time to time, provided the overall subscription continues to deliver substantial value consistent with the offering described at purchase.

4. Free Trial and Auto-Renewing Subscriptions

We may offer a free trial of SpaSync Premium from time to time. The duration and conditions of any free trial (including length, eligibility, and what happens when the trial ends) are those shown in the App and in the App Store at the time you start the trial or subscribe. Those details control if they differ from this summary.

Unless you cancel before the trial ends in accordance with Apple's subscription flows, your subscription may automatically convert to a paid Premium Subscription and your Apple ID may be charged at the then-current price. You can manage or cancel during the trial or thereafter in your App Store Account Settings.

By selecting a paid Premium Subscription (including after a free trial), you agree to the following:

  • Payment: Payment will be charged to your Apple ID account at the confirmation of purchase (or at the end of any applicable trial, as shown at subscription).
  • Auto-Renewal: The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the original subscription price (or then-current price if Apple or we communicate a change in accordance with App Store rules).
  • Management: You can manage or cancel your subscriptions by going to your App Store Account Settings after purchase.
  • Refunds: All purchases are subject to Apple's standard App Store refund policies. We do not process refunds directly.

5. User Accounts and Security

To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You can request to delete your account and associated data at any time via the "Delete Account" option in the App's settings.

6. Hardware Control and Limitation of Liability (Important)

SpaSync acts solely as a remote control interface for third-party hardware (your spa equipment). By using the App, you acknowledge and agree that:

  • No Hardware Warranty: We do not manufacture, maintain, or warrant the physical spa equipment, WiFi modules, or sensors.
  • Assumption of Risk: Remotely controlling spa equipment (including temperature, pumps, and heaters) carries inherent risks. You are solely responsible for ensuring the safe operation of your spa.
  • Limitation of Liability: To the maximum extent permitted by law, SpaSync and its developer shall not be liable for any direct, indirect, incidental, or consequential damages resulting from: (a) hardware failures or malfunctions; (b) property damage, elevated energy bills, or personal injury resulting from extreme water temperatures, overflow, or equipment states triggered via the App; (c) network outages or the App's failure to communicate with your spa.

7. Network and Connectivity

The App requires a functioning local WiFi network and/or internet connection to communicate with your spa. We do not guarantee uninterrupted access, and the App may fail to send commands or receive data if your network is unstable or disconnected.

8. Third-Party Services

The App relies on third-party platforms and services to operate, including but not limited to: Apple (including the App Store, StoreKit, device and system services, and WeatherKit where used); Google (Firebase for authentication, cloud data, analytics, messaging, and related infrastructure); and RevenueCat (subscription management). Those providers are not parties to these Terms and have their own terms and privacy policies. We are not responsible for third-party services, outages, or changes outside our reasonable control.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and safeguard your data, including location data and local network access.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of this document. Continued use of the App after changes are made constitutes your acceptance of the revised Terms.
